Mandatory Insurer Reporting Useful Links

 

Section 111 of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (MMSEA) (P.L. 110-173), adds new mandatory reporting requirements for group health plan (GHP) arrangements and for liability insurance (including self-insurance), no-fault insurance, and workers' compensation. See 42 U.S.C. 1395y(b)(7) & (8).

Centers for Medicare and Medicaid Services (CMS) are implementing the MSP Regulation through the Coordinator Of Benefits and the Medicare Secondary Payer.

Responsible Reporting Entities, Insurers (including self-insured employers) and their agents are responsible for providing the keports, or face penalties.

Employers will have to provide insurers additional information or face penalties.

Existing MSP regulations requiring reporting of MSP occurences (beneficiaries and their attorneys) can be monitored and thereby more readily enforced.
